Understanding Trusts
A trust is a written agreement between the grantor creating the trust and a trustee (or grantee) that will manage and distribute the trust according to specific details in the document. Once established, assets may be transferred into the trust for the benefit of spouses, children, other family members, or entities defined as beneficiaries.
Trusts can be advantageous for estates of any size and individual need, including exclusion from the probate process to shelter assets from creditors, taxes and public scrutiny. Do-it-yourself, cookie cutter trusts are not personalized for your unique situation and cannot possibly cover every necessary detail. Our estate planning services provide creative trust strategies customized to meet your goals.

Revocable Trusts vs. Irrevocable Trusts
In general most trusts are "living trusts," as they are created by you during you lifetime. A revocable trust gives you (the grantor) the right to change or dissolve the trust while you are still alive and of sound mind. An irrevocable trust means you give up your right to alter or cancel the trust once it becomes effective. Unless specified otherwise, revocable trusts become irrevocable upon your death.
Types of Trusts
Brandner & Ponzini trust lawyers are knowledgeable and skilled in helping you determine which kind of trust will help you accomplish your asset preservation goals. Trusts we can help clients establish include:
- Special needs trusts - to keep you from jeopardizing your eligibility for government benefits such as Medicaid or Medicare, or to provide for a disabled child or other family member's care
- Charitable trusts - these are for the benefit of a charitable organization, common options include payments for fixed number of years, and provisions for remainder amounts
- Life insurance trusts - an irrevocable trust with life insurance on the grantor and proceeds payable at death; the assets in these trusts are exempt from estate taxes
- Other trusts - such as spendthrift trusts, generation-skipping trusts, marriage deduction trusts, testamentary trusts and more
